Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ThinkaBit application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is operated by BCI Consulting ("we", "us", or "our").

2. Account Creation & Parental Responsibility

  • Only a parent or legal guardian may create a ThinkaBit account.
  • You must be at least 18 years old to create an account.
  • You are responsible for all activity under your account, including any child profiles you create.
  • You must provide accurate information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials and Parent PIN.
  • You must promptly notify us of any unauthorized use of your account.

3. Age Requirements

  • ThinkaBit is designed for children ages 7-12.
  • Children under 13 may only use the App with verifiable parental consent, in compliance with COPPA.
  • Parents must verify that their child meets the minimum age requirement before creating a child profile.
  • We reserve the right to terminate accounts that we reasonably believe violate these age requirements.

4. Subscription Terms

  • Free Tier: Limited access to introductory lessons at no cost.
  • Paid Subscriptions: Full access via monthly ($4.99/month) or annual ($39.99/year) subscriptions.
  • Subscriptions are processed through Apple App Store or Google Play and are subject to their respective terms and policies.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage and cancel subscriptions through your App Store or Google Play account settings.
  • Refunds are handled by Apple or Google per their refund policies.
  • Prices may change with advance notice. Existing subscriptions will not be affected until renewal.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's servers or networks
  • Attempt to gain unauthorized access to any part of the App
  • Use automated systems (bots, scrapers) to access the App
  • Share your account credentials with others
  • Use the App to harass, bully, or harm others
  • Misrepresent your identity or your child's age

6. AI-Generated Content Disclaimer

ThinkaBit teaches children about artificial intelligence through educational content including stories, scenarios, quizzes, and interactive activities. Some lesson content may include AI-generated examples for educational purposes.

  • All AI-generated content is clearly labeled and used for educational demonstration only.
  • AI-generated examples (such as deepfake demonstrations) are fictional and not intended to represent real people, events, or information.
  • We review all content for age-appropriateness before it is made available in the App.
  • The App does not use AI to communicate directly with children or generate personalized content in real-time.

7. Intellectual Property

  • The App, including all content, characters (Sparky, Glitch, Professor Pixel), artwork, animations, lesson content, code, and design, is the intellectual property of BCI Consulting.
  • You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial educational purposes.
  • You may not copy, modify, distribute, sell, or lease any part of the App.
  • Creative works made by children using the Workshop feature belong to the child/parent, but we retain a license to display them within the App.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The App is provided "as is" and "as available" without warranties of any kind.
  • We do not guarantee that the App will be uninterrupted, error-free, or secure.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
  • Educational content is for informational purposes only and does not constitute professional advice.

9. Termination

  • You may stop using the App and delete your account at any time.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your right to use the App ceases immediately.
  • Account deletion will remove all data as described in our Privacy Policy.
  • Sections on Intellectual Property, Limitation of Liability, and Governing Law survive termination.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the Netherlands.

11. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.
